2 mins readThe National Democratic Congress (NDC) Parliamentary Candidate for Nsawam Adoagyiri, Amenorpe Philbert Fummey, has taken legal action against the Electoral Commission (EC), demanding a fresh election in the constituency. Fummey has filed a lawsuit at the Accra High Court, accusing the EC of using invalid pink sheets to collate the election results.

The New Patriotic Party (NPP) parliamentary candidate, Frank Annoh Dompreh, is also named as a defendant in the case.The lawsuit, filed on Friday, December 13, by Fummey’s lawyer, Godwin Edudzi Kudzo Tameklo, who is also the Director of Legal Affairs for the NDC, includes a motion for an interlocutory injunction.

The injunction seeks to halt the collation of the results for Nsawam Adoagyiri until the court reaches a final decision on the case.Fummey’s complaint stems from an alleged attack at the collation center, which he claims was carried out by individuals he believes to be NPP members. During the attack, several pink sheets were destroyed.

According to Fummey, by the time of the attack, he and his team had already collated results from 118 of the 203 pink sheets. After the destruction, Fummey asserts that only 137 pink sheets remained in his possession, while the EC reportedly held 80 percent of the pink sheets.

Despite the destruction of some of the pink sheets, Fummey claims that the EC proceeded with the collation process, even after initially indicating it had not received all the pink sheets. Fummey argues that the EC’s decision to continue with the process, despite these discrepancies, undermines the integrity of the election.

In his suit, Fummey is seeking a declaration that the election results for Nsawam Adoagyiri have been compromised due to the “absence, incomplete, and/or questionable nature of the pink sheets.” He further requests the court to rule that the EC cannot lawfully declare a winner for the constituency under these circumstances.
