2 mins readThe Minority in Parliament has challenged the Koforidua High Court’s decision that found Akwatia MP Ernest Yaw Kumi guilty of contempt and ordered his arrest.

In addition to the appeal, they have also requested that the court temporarily halt its order while the case is being reviewed.

The Koforidua High Court ruled that Ernest Yaw Kumi was in contempt for ignoring a court order that stopped him from being sworn in as a Member of Parliament.

When he failed to appear for sentencing, the court issued a warrant for his arrest.

Speaking to journalists, Second Deputy Minority Whip Jerry Ahmed Shaib criticized the court’s decision, saying it was too severe and that the Minority did not agree with it.

“Legal steps have been taken. A notice of appeal has been filed against the ruling of the high court at the court of apeal. An applictaion for stay of execution pending appeal has also been filed at the high court in Koforidua."

Moreover, all the parties to the section to the certiorari and prohibition application including the judge, His Lordship Justice Emmanuel Senyo Amedeheh who is the respondent to this application before the supreme court have been duly served. Further legal steps will be taken and the minority caucus in parliament will aabreast he Ghanaian public on the way forward. ,” he stated.

He also emphasized that Ghana’s democracy is based on fairness, justice, and the rule of law, warning that the court’s decision not only affects Ernest Yaw Kumi’s rights but could also undermine the country’s democratic principles.

Mr Shaib further stated that Ghana's democracy is rooted in fairness, the rule of law, and justice.

Thus, the actions against MP Ernest Yaw Kumi not only violate his rights but also pose a threat to the country's democratic foundation.
